GENERAL TERMS AND CONDITIONS OF ONLINE SALE
These Terms and Conditions are entered into by, on one side, CATHY AMOUROUX, a sole proprietorship whose registered office is located at 15 rue Pierre Loti, 33800 Bordeaux, France, registered under number 533 821 930 at the RCS Bordeaux, hereinafter referred to as “CATHY AMOUROUX”, and on the other side, by any individual or legal entity wishing to purchase via the website www.cathyamouroux.fr, hereinafter referred to as “the Buyer”.
Article 1 – Purpose
These Terms and Conditions define the contractual relationship between CATHY AMOUROUX and the Buyer and the conditions applicable to any purchase made via the website www.cathyamouroux.fr.
Purchasing a product through this site implies full and unconditional acceptance of these Terms and Conditions, which the Buyer acknowledges having read before placing the order.
The Buyer declares that any product purchased through www.cathyamouroux.fr is for strictly personal use and unrelated to their professional activity, and that they have the legal capacity to enter into this agreement.
CATHY AMOUROUX reserves the right to update these Terms at any time, in compliance with new legal requirements or in order to improve the user experience. The applicable Terms will be those in effect on the date of the order.
Article 2 – Products
The products offered for sale are those listed on www.cathyamouroux.fr.
CATHY AMOUROUX reserves the right to modify the product range at any time.
Each product is described with its main characteristics (composition, usage, dimensions, etc.). Photos are as accurate as possible but are not contractually binding.
Pre-order offers are valid only within the time frame and quantity specified.
Article 3 – Prices
Product prices are listed in euros (€), all taxes included (TTC), based on the VAT rate applicable on the order date.
Any change in the VAT rate may be reflected in the product price.
CATHY AMOUROUX may change prices at any time, but the applicable price is the one shown at the time of order validation.
Delivery fees are not included in product prices and are calculated separately.
Article 4 – Orders and Payment
Orders must be paid in euros. The only payment method available is:
– Bank card via Shopify Payments.
The Buyer selects items, updates quantities and shipping address if needed, then sees calculated shipping costs and chooses their payment method. After validating the order and accepting these Terms, the Buyer is redirected to the secure Mollie platform to enter payment details.
Once payment is validated, the order is recorded and the contract is considered binding. Payment by card is final.
A confirmation email will be sent once the order is registered.
Any banking fees charged by Shopify Payments are covered by CATHY AMOUROUX. Other banking fees will be charged to the Client.
CATHY AMOUROUX reserves the right to cancel or suspend any order or delivery in the event of payment issues, previous unpaid orders, or ongoing disputes.
Digital records stored securely by CATHY AMOUROUX serve as proof of transactions.

Article 5 – Retention of Title
Ownership of the products remains with CATHY AMOUROUX until full payment has been received.
Article 6 – Right of Withdrawal
In accordance with Article L121-20 of the French Consumer Code, Buyers have 14 business days after delivery to exercise their right of withdrawal and return products for refund or exchange, except return shipping costs.
Article 7 – Shipping
7.1 Delivery Area & Methods
Delivery is made to the address indicated by the Buyer at checkout.
Delivery options include:
– Colissimo with signature (France & EU)
– Mondial Relay (pickup point, France only)

Delivery times are indicative. If a delay exceeds 30 days from dispatch, the sale contract may be cancelled, and a refund issued. Shipping risk transfers to the Buyer upon dispatch.
The Buyer must inspect the package and report any damages within 3 days to the carrier and to CATHY AMOUROUX.
Incorrect or incomplete delivery addresses are the responsibility of the Buyer.
7.2 Delivery Times
– In-stock products: 3 business days
– Pre-orders: production starts after the pre-order period and takes around 2 months. Delivery follows (approx. 3 business days).
Timelines may vary depending on production volume and handmade processes. Customers are kept informed by email and social media.
7.3 Receipt
Delivery is deemed complete upon package handover by the carrier.
The Buyer must check the condition of the package and contents upon receipt and report any issues to the carrier and to CATHY AMOUROUX within 3 days.
Invoices can be sent to the billing address upon request.
Shipping and return costs are at the customer’s expense unless otherwise stated.
Article 8 – Returns & Refunds
Fabrics sold by the metre:
Due to the custom-cut nature, returns and exchanges are not accepted unless the product is faulty or does not match the order.
In accordance with Article L221-28 of the Consumer Code, custom-made or clearly personalized goods are excluded from the right of withdrawal.
Clothing and Accessories:
Returns/exchanges are free within France. Items must be returned within 14 days of notice of withdrawal, in their original packaging and perfect condition (unworn, unwashed).
If the return is lost or damaged, the customer is responsible.
Items not returned in compliance with these terms will not be refunded or exchanged.
Refunds are processed within 14 days of either (i) receiving the returned item, or (ii) receiving proof of shipment.
Refunds are issued to the same bank account used for payment. If your account has changed, please update your bank accordingly.

Article 9 – Legal Warranty
All products are covered by the legal warranty under Articles 1641 and following of the French Civil Code. In case of defect, products may be returned for refund or replacement.
Article 10 – Liability
CATHY AMOUROUX is only bound by a best-effort obligation in the distance-selling process. We shall not be held liable for damages caused by Internet usage (e.g., data loss, hacking, virus, service interruption).
Article 11 – Intellectual Property
All elements on www.cathyamouroux.fr (texts, visuals, logos, photos) are the exclusive property of CATHY AMOUROUX. No reproduction or use is permitted without prior written authorization.
Article 12 – Personal Data
CATHY AMOUROUX is committed to protecting the confidentiality of your personal data.
Under Law No. 78-17 of January 6, 1978, you have the right to access, rectify, and delete any data concerning you.

Article 13 – Disputes
These Terms are governed by French law. In case of dispute, the Buyer should first contact CATHY AMOUROUX for an amicable resolution.
In accordance with consumer law, you may also contact a mediation service free of charge. You may consult the list of mediators here or submit a complaint through the European online dispute resolution platform here.
A mediator may refuse your request if:
– You haven’t first contacted CATHY AMOUROUX
– The request is abusive or outside their scope
– The case is already being handled by another mediator or court
– You submit the request more than a year after your original complaint
Article 14 – Data Protection
To provide services on the site, CATHY AMOUROUX may collect and process personal data from your order.
These are used to manage orders, provide services, and perform internal analysis.
Data may be shared with third parties involved in service provision.
